By accessing or using Counterpunch App ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Counterpunch App is a font editor application available in two forms:

• Open Source Version: The core font editor software is open source and freely available under the terms of its open source license (as specified in the project repository).
• Commercial Service: We offer paid subscription plans that include additional features, including but not limited to AI assistant functionality.

3. User Accounts and Registration

To access certain features of the Service, including paid subscriptions, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Paid Subscriptions

4.1 Subscription Plans

We offer monthly subscription plans that provide access to premium features. Current pricing and plan details are available on our website and may be updated from time to time with advance notice.

4.2 Tool Credits

Monthly subscription fees are structured as follows:

• 50% of your subscription fee is allocated to your account as "tool credits" each billing period
• Tool credits can be used to access premium features, including the AI assistant
• Tool credits are non-refundable and expire at the end of each billing period unless otherwise specified
• Unused credits do not roll over to subsequent periods
• Additional credits may be purchased separately as usage-based add-ons

4.3 Billing and Payment

Subscriptions are billed on a recurring monthly basis. You authorize us to charge your payment method for all fees incurred. If payment fails, we may suspend or terminate your access to paid features.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial months or unused tool credits, except as required by law.

5. AI Assistant

5.1 Usage

The AI assistant feature uses tool credits and may incur additional costs based on usage. Costs will be deducted from your available tool credit balance.

5.2 Accuracy and Reliability

The AI assistant is provided "as is" and may produce inaccurate, incomplete, or inappropriate results. You are solely responsible for reviewing and verifying any output from the AI assistant before using it in your projects. We do not guarantee the accuracy, quality, or suitability of AI-generated content.

5.3 Data Processing

When using the AI assistant, your prompts and generated content may be processed by third-party AI service providers. By using this feature, you consent to this processing. Do not submit confidential, proprietary, or sensitive information through the AI assistant.

6. Intellectual Property

6.1 Your Content

You retain all rights to fonts, designs, and other content you create using the Service ("Your Content"). You are responsible for ensuring you have the necessary rights to any materials you upload or use with the Service.

6.2 Our Content

The Service, including its design, features, and branding (excluding the open source components), is owned by us and protected by intellectual property laws. The open source components are licensed under their respective open source licenses.

6.3 License to Use Your Content

You grant us a limited, non-exclusive license to host, store, and process Your Content solely to provide the Service. We will not use Your Content for any other purpose without your consent.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose

You are responsible for maintaining backups of Your Content. We are not liable for any loss, corruption, or unauthorized access to Your Content.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

The open source version of the font editor is licensed separately under its respective open source license. These Terms apply to the commercial Service and do not supersede or modify the terms of the open source license. Use of the open source software is governed by its license, not these Terms.

14. Export Controls

You agree to comply with all applicable export and import control laws and regulations. You may not use or export the Service in violation of such laws.

15. Governing Law and Disputes
